The Short Answer
Not always. Nearly every federally issued record can be apostilled as a notarized true copy with a state apostille, which is usually the faster route. Many, though not all, can also go through the US Department of State on the federal route, and that door is only open when the copy in your hand carries a federal official's signature. Being issued by a federal agency does not by itself put a document on the federal path. The apostille attaches to a signature, not to the letterhead above it.
The US Department of State states the rule from its own side. Its preparation page says an apostille certificate applies when your document is signed by a US federal official, a US consular officer, or a foreign consul registered with the Department's Office of Protocol, and that the document must carry original seals and signatures, the date it was issued, and agency letterhead. The same page tells you not to notarize the document, because a notarized document is no longer valid for that process (travel.state.gov, Preparing a Document for an Apostille Certificate).
So the question that decides your route is not "which agency issued this" but "does the copy in my hand carry the signature of a federal official?" A large share of federal records do not. An SSA benefit letter printed from a my Social Security account, a DD-214 released by the National Archives, and the IRS CP 575 EIN confirmation letter routinely arrive with no signing official on them, and the Office of Authentications has nothing to authenticate on a page like that.
That is why every federal document in our queue defaults to the True Copy State Apostille except one: the FBI Identity History Summary. Federal processing stays available on request. It takes the physical original, runs an estimated 6 to 14 business days, and cannot be expedited. State true copy processing runs 1 to 6 business days depending on the tier, and that is processing time only, with shipping separate.
For a Federal Document There Is No State Original Route
With a state document you have two ways to go: a notarized true copy apostilled at state level, or the original sent to the Secretary of State that issued it. For a federal document the second one does not exist. A state Secretary of State has no jurisdiction over a federal record and cannot apostille it under original document processing. That leaves two real routes:
- US Department of State, Office of Authentications. The physical original, signed by a federal official, unnotarized. The government fee is $20 per document and is nonrefundable under federal law (Requesting Authentication Services).
- State apostille on a notarized true copy. A notary certifies the printed copy as a true and accurate reproduction, and the Secretary of State apostilles the notary's certification. The apostille comes from the state where the notary is commissioned, which is why it often names a state that has nothing to do with the issuing agency.
Both produce a genuine apostille valid under the Hague Convention. They authenticate different signatures, which is the distinction covered on state vs federal apostille.
The Routing Table
Default route means what we recommend when nothing else in the order changes it. The federal route stays open in every case where you ask for it and the document qualifies.

The Department of State's own examples of federal documents handled by that office include animal and plant health certifications from USDA, federal court documents and FBI background checks from the Department of Justice, certificates of naturalization from DHS, certificates to foreign governments and pharmaceutical product certificates from HHS, patent and trademark applications from USPTO, certification of US tax residency from the IRS, and documents from EPA, the Social Security Administration and the Office of Personnel Management (Preparing a Document for an Authentication Certificate). Being on that list means the office can handle the document type. It does not mean the specific copy you hold qualifies. That still comes down to the signature.
One clarification that saves people an order: if a foreign authority is asking for proof that you are a US tax resident rather than for the return you filed, the document usually meant is Form 6166, which the IRS issues on Treasury stationery after you file Form 8802, not a copy of your 1040 (IRS, Form 6166). Ask which one they want before you order either.
Five That Need More Than a Table Row
The FBI Identity History Summary, and Why It Is the Exception
The FBI states that it authenticates fingerprint search results by placing the FBI watermark and the signature of a division official on the results, and that documents authenticated by the FBI may then be sent to the US Department of State by the requestor to obtain an apostille (FBI, Identity History Summary Checks FAQs). That signature is why this document, and effectively only this document, moves cleanly through the federal channel.
It also answers a question customers ask constantly: why the FBI check needed no notary when their other documents did. Nothing is notarized on the federal path, because the Department of State authenticates the FBI official's signature directly. Intake is narrow: the original downloadable FBI PDF, or the original physical document. The Consular Report of Birth Abroad Has Its Own Channel
A CRBA is a Department of State document, so people assume it goes to the Department of State's authentication office like an FBI report. It does not. Apostilles on consular records are handled by Passport Vital Records, and the request is made with a notarized Form DS-5542 plus a photocopy of the record holder's photo ID and payment. The Department quotes 4 to 8 weeks for requests to that office, and states that if the CRBA was issued within the last five years there is no apostille fee (Replace or Amend a Consular Report of Birth Abroad).
Because that form is notarized in the record holder's own name, it is not something a service can file for you. We handle CRBAs on the true copy state route and tell customers plainly that the federal apostille on a CRBA is theirs to request.
Naturalization and Citizenship Certificates
USCIS will make and certify a true copy of a Certificate of Naturalization itself when a foreign government or embassy asks for one. It is done in person at a field office with both your original and your photocopy, and USCIS states it does not certify copies through the mail or electronically. On the same page USCIS notes that although the law prohibits duplication of naturalization certificates, certificates of citizenship and permanent resident cards for some purposes, that prohibition does not apply to making a photocopy for submission to USCIS with an application or petition (How Do I Obtain Certified True Copies of a Certificate of Naturalization?).

USDA Pet and Animal Export Certificates, Where Timing Decides Everything
APHIS endorses international health certificates for animals leaving the United States, increasingly through the Veterinary Export Health Certification System. Some destinations accept that digital endorsement, others still want an apostille or a consular step on top, so check the destination's own page on the APHIS site (APHIS, Take a Pet From the United States to Another Country).
The operational point is arithmetic. Health certificates for animal export are time-limited by the destination, measured from the date of veterinary certification, and those windows are short. A federal apostille estimated at 6 to 14 business days with no expedited option does not fit inside one. When a destination gives a 10 day window between veterinary certification and arrival, the honest answer is that the federal path cannot be made to work in the time available.
FDA Export Certificates
FDA publishes its own route. For cosmetic export certificates it tells exporters that the request goes to the Office of Authentications with the original certificate downloaded and printed from FDA's Certificate Application Process, a Form DS-4194 and payment, and that apostilles and authentications must be printed in color to be valid (FDA, Cosmetics Export Certificate FAQs). For medical devices FDA points foreign authorities to an online certificate validator instead.
We route FDA certificates as true copy state by default. What we cannot do is tell an exporter which FDA documents a foreign customs authority wants apostilled. Only the authority asking for them can confirm that.
What Actually Goes Wrong, in Five Recurring Patterns
The visa file with a Schedule SE and an FBI check. The attorney abroad asks for an apostilled Schedule SE and cannot say whether it needs notarizing first, or why the FBI background check in the same application did not need one. The Schedule SE goes the true copy state route, with the notarial certification prepared as part of processing rather than something the applicant arranges. Two federal documents, two different routes, and one rule was assumed to cover both.
The DD-214 in a citizenship file. A military discharge record from the National Archives reads as federal and therefore federal-path, until review finds no issuing official's signature block on the copy, which closes the federal route for that document in that form. It runs as a true copy, at the one business day tier when the deadline demands it. Veterans and next of kin can request DD Form 214 copies free from the National Archives through eVetRecs or a signed SF-180 (National Archives, Request Military Service Records).
Two SSA statements, one order, one failure. Two Social Security statements arrive in the same order and one has no issuing official's signature block, so federal processing is unavailable for that one and still possible for the other. Both can run true copy, and the federal option should be noted for the qualifying statement rather than quietly dropped.
The SSA letter refused at the counter. Walk-in submissions in Washington DC see it directly: the FBI letter is apostilled, the Social Security letter is refused because no SSA officer signed the form. There is nothing to fix on the document itself. It goes through as a true copy.
The EIN letter that has nowhere else to go. An IRS CP 575 EIN confirmation letter in a corporate document set cannot take a federal apostille, because it has no issuing official's signature block, and cannot take a state original apostille, because a state cannot apostille a federal record. True copy is not the cheaper option. It is the only option.
The Part We Cannot Answer for You
An apostille is valid under the Hague Convention when a Secretary of State or the US Department of State issues it. It does not settle whether the authority on the other end accepts the underlying document, in the form you sent it, on the date you send it.
Two consequences. If your receiving authority has told you in writing that it wants an apostille from the US Department of State specifically, say so up front, because that changes the route, the intake (physical original) and the timeline (6 to 14 business days, no expedited tier at any price). And freshness windows belong to the receiving authority, not to the apostille: the certificate has no built-in expiration date, and the underlying document keeps whatever issue date is printed on it, which is covered on do apostilles expire.
